Alabama Supreme Court Shows the Way

The Alabama Supreme Court, on the last day of 2016, unanimously ruled that a wrongful death lawsuit can proceed.

What makes this statement extraordinary is that the wrongful death in question is of a “non-viable fetus,” a pre-born baby who allegedly died as the result of malpractice by a doctor.

No Rules Apply When Abortion Involved

Two safety provisions of a 2013 Texas law addressing abortion providers were rejected by the U.S. Supreme Court in a late June decision: the need to meet ambulatory surgical center standards and admission privileges for abortionists at a hospital within 30 miles.

As reported in the National Catholic Register, Justice Stephen Breyer, in his majority opinion, stated that “neither of these provisions offers medical benefits sufficient to justify the burdens upon access that each imposes.”

Two Titans Lost in February

Two titans to the pro-life community were lost in February.

Nationally, the death of Supreme Court Justice Antonin Scalia not only put in jeopardy several cases pending before the court, it left the court without the reasoned voice of a man who understood the natural law and who upheld the principles and limits of government as handed down to us by our nation’s founding fathers in the U.S. Constitution.

Supreme Court Further Erodes Position of Children

As reported by Breitbart, the American College of Pediatricians has concluded that the Supreme Court decision legalizing “same-sex marriage will have a significantly negative impact on children in the United States.”

The Court is continuing to erode the position of children in our society, a process that was strongly pressed with the Roe v. Wade and Doe v. Bolton decisions in 1973. These decisions essentially held children to be property that could be kept or disposed of according to the desires of the parents.

OPPOSE Senate Bill 2578 That Revokes Conscience Rights

On June 30, the U.S. Supreme Court ruled in Burwell v. Hobby Lobby Stores that the HHS contraceptive mandate cannot be used to force a family business to provide coverage for drugs and devices that violates the family members' religious convictions. The Court relied on the Religious Freedom Restoration Act (RFRA), passed overwhelmingly by Congress and signed by President Clinton in 1993. Legal challenges by non-profit religious groups are still pending.

Sen. Patty Murray (D-WA) and Sen. Mark Udall (D-CO) have introduced a bill (S. 2578) that would not only reverse the Hobby Lobby ruling, but would go far beyond that decision. It denies any right that employers, insurers or employees may have, under RFRA or any other federal law, to opt out of federally mandated coverage.
